Are these manufacturing inconsistencies?

If not, which one is legal?

Also, out of the three which would be fastest? (illegal)

Doesn't back pressure give you more bottom end? If so then opening it up could possibly cost you time. Or does it not matter with the pipe, because of the powervalve? So being that the powervalve would control bottom end, then we would gain more top end with the opened pipe. If that is the case would it make the transition way more noticeable or would it just change the RPM of the optimum transition?
